As DaleStan suggested, the best thing is not to speculate way too much until someone talks to a qualified person.

just redraw the existing graphics. All of them. BUT! make it so you can import the graphics from TTD, if you own it.

Well, some people are presenting how they think copyright works, which is, in my opinion, sometimes far from reality. I'm not a lawyer, but I'm a bit interested in author laws, so some points - it's based on Czech law, so it may not apply exactly in your country, but I think the system will be similar.
- you don't register to get author rights. You get them as soon as you create something. The thing that can be registered is software patent, but that's different thing and also they are not valid in Europe... and hopefully they never will be.
- You cannot simply take somebody's work, change it a bit and say it's your work even if you mention the original author name. So if OTTD is "illegal", mentioning author anywhere in the game won't help it.


So, now what's important about being independent on original TTD files; if you copy files from the original game without being owner of the game, it's software piracy. No one will propably arrest you for doing it at home, however it means that if you put OTTD on the net for download and you include the files in your download you risk that you'll be asked to remove it or actions will be taken against you (like your account deleted or so)

About the game itself... it's different code doing similar thing. So, if CS proves that he's the author of the original game and that OTTD was inspired by it (which propably won't be hard), he would propably win the process, depending on country where it would take place.
*BUT*
The point is that nobody would bother. Why would CS sue non-commercial project led by group of students about copyright on 10-year old game? It would only hurt his reputation.

Has anyone considered just getting in touch with him and asking? Also, keep in mind that the graphics weren't done by CS so he may not have the right to say if we could use them.

I'm pretty sure he knows about this already anyway. I know if I developed anything that was at all successful I would love watching what people said about it and what sprouted up in the future in relation to it.

I'd also like to add the "idea" thread: Chris Sawyer had an idea of making TT, he did it, and anyway how we manage to make OTTD legal, it will be his idea.

This has been brewing for quite some time, now. It isn't particularly directed at any one person, more at the general "me-too"-ing (that I'm guity of too) that keeps this from dying.
To get a good answer, ask a Smart Question. Similarly, if you want a bug fixed, write a Useful Bug Report. No TTDPatch crashlog? Then follow directions.

No speculation here (well a little bit :wink: ) :

1. Whether OTTD source code is legal or not is a matter for the courts which is unlikely to happen and even if it does the decision would almost certainly be in favor of OTTD, no matter where the case was heard.

2. Distributing TTD graphics with OTTD is DEFINATELY a breach of copyright which is why we must make replacement graphics.

End of story. :)

Minor point but isn't this thread about making a new trainset, not the legalities of OTTD?

We've already agreed it's better to make a new trainset. either because of the copyright, or because when the new tracktypes come along, they'll need new trains, along with the potentially increased game-time length (going beyond 2050 and before 1930.

OK, then what do we need? Lemme try this:

Standard rails:
5 streamers (Same stats as regular ones)
5 diesel trains (The worst diesel is worse then the secound best steamer)
2 passanger only trains (Ones that has a head and a tail engines, and a passanger coach each)

Electric rails:
5 standard eltrains (Worst train is worse tehn the best diesel)
2 passanger only trains

ManLev:
4 pasanger only tains (I doubt manglev vill ever be used for gods)

Monorail: How about 3 or 4 monorails, like in maglev?

But I do not think that they will be used for coal and iron ore, at least not for many years. Maybe some day in the far future

Unless something has changed (can one of the devs please confirm the following), these are the types of tracks we're playing with in the future:

0 - Road (8 way, two sets, one for left hand drive, one for right hand drive)
1 - Normal Rail (what we have now, limit 160km/h on straights)
2 - Normal Rail with overhead wires.
3 - High Speed Rail (rail on a concrete foundation, up to 300 - 350km/h)
4 - Maglev / Monorail.
5 - Narrow Gauge (has two tracks in the main directions, instead of one)
6 - Trams (basically narrow gauge plus roads)
7 - Rack Railway (a third, toothed rail in the middle)


So any new trainsets would hopefully take that lot into account.

My idea is to allow trains drive on tracks that are not on road, too.
It would be pretty dumb if trains track would be built on roads only, I think.
But there should be also some difference between narrow gauge and tram... hmm... just a different graphic for tracks and wagons?

I think we should just focus on the replacement of the current trains in here, not what will go on new tracks.

Having said that i think normal->ekectrified->maglev is the way to go (like the patch)
