I'd say it's still polite to ask permission of the original author despite any copyright restrictions (or lack of).

Although it does look good :)

Unless an author or artist expressly disclaims copyright, then copyright is automatically assigned. Art is not created out of the void, somebody did something somewhere, and thus copyright protects both them and their work.

How do you know that those graphics were released to the public domain by the artists?
Or is anything which can be downloaded somewhere (like OpenTTD) without copyright?
Or my avatar. You can freely "download" it from this website. Do you think this gives you permission to use it for any publication without asking me first?

Yes you are right about this but does this also count for when you draw something with chalk on a street and you leave it that you also have copyright? (as example)
planetmaker wrote:How do you know that those graphics were released to the public domain by the artists?
How did i otherwise got the sprites? If it wasn't downloadable then i couldn't use this.

No you are right about asking but that website i got it from is down some years ago. I got the sprites two years earlier. That person can't be contacted anymore.

Also a question: When the sprites are shrinked much smaller that the original/has been heavily modified (can't recognise it from the original) it still has copyright?

 UPDATE: (Actually a DOWNDATE)
- I will scrap the Top Scan Ride. I will go on with other Rides.

That makes it pretty easy, don't you think? With that argument I can always argue that I tried to contact the copyright holder an then happily use or sell that piece of art. Try to tell that a court...
No contact = no answer = no permission
Also a question: When the sprites are shrinked much smaller that the original/has been heavily modified (can't recognise it from the original) it still has copyright?
Everything has copyright. The question is whether _you_ are the copyright holder or another person. There borders between "inspired from" (which most often is allowed" and "derived from" (which most often is not allowed) are not clearly defined. And in case of doubt they're defined by a court when someone thinks that his or her copyright was infringed and tries to sue the other person for compensation. It's up to you to know at which side of this line you are.

I doubt that many people would go that far, but if they make their living on such things, they might; as a guide, though I only know really pricing for photography (thus a thing like my avatar), but his will be very similar: per license for a quality photo you can calculate 100€. Unauthorized use is (in Germany) usually awared at least the tripple normal fee by courts plus costs of lawyer etc ;-)

You are right. In the future i will look more carefully before i do something...

Unless the image was released into the public domain, which means you can do whatever you want with it.
Usually when people don't post any license information, they either stole the image from somewhere else, or they simply forgot. Can't do much if you can't ask them anymore...

Aaah, the plague that is copyright...
1. Don't use graphics without permission, it is illegal and you could (though it is very unlikely) get sued or similar.
2. Don't trace, copy/paste chunks, resize and use as a basis for your graphics - these are no better than copying the whole thing.
3. Always ask to ask if you can use the images, many many people will say yes.

I know now that when you can download something i will look if there is a license or i can contact the author.
But for now i will be much more careful now now i know i could get into trouble.

I will look many times before i use something that is put on the Internet.

I will be much more careful next time... I have learned my lesson...

And now back to Funfairs.

FooBar, what are the settings for the gaussian noise you used on my Stalls? I can't reproduce it...
