6. April 2005: Der Gutachter gutachtet
Die Gegenseite hat offenbar grünes Licht gegeben (was mich jetzt doch etwas verwundert, sind denen die Ideen am Ende doch ausgegangen?) und W. Bannwitz konnte sich nun endlich an die Arbeit machen. Zuerst einmal hat er mich zu Tode erschreckt, als er mich anrief, weil er 3DTT nicht starten konnte, und dann lief es auf seiner schwer veralteten S3-Grafikkarte mehr schlecht als recht.
Diese Probleme sollten aber inzwischen kein Hindernis mehr darstellen. Nichts kann jetzt noch den Vergleich verhindern, und jetzt werden wir ja sehen, wer recht hat.
Ärgern tu ich mich nach wie vor darüber, daß die Gegenseite den Sourcecode hat verschwinden lassen und trotz ihrer ungeheuer schlecht vorgebrachten Lügen dafür keins auf den Deckel bekommen hat. Die Sourcecodes zu vergleichen, hätte sehr viel Zeit gespart, und dem Gutachter eine Menge Arbeit. Wäre es nach mir gegangen, hätte 2002 eine beweissichernde Hausdurchsuchung stattgefunden.
Gottlob macht das Fehlen den Vergleich nicht gänzlich unmöglich. So gründlich Uebbing jetzt beim Verschleppen des Prozesses ist, so schlampig hat er damals die Spuren seiner Tat verwischt. An den compilierten Dateien von Schiene und Straße klebt immer noch so viel Blut (um es mal dichterisch auszudrücken), daß man kein Genie zu sein braucht, um zu sehen, was Sache ist. Insbesondere die unwahre Behauptung, Schiene und Strasse sei in C++ geschrieben worden, wird Uebbing das Genick brechen.
Bin ich ein schlechter Mensch, weil ich mich auf den strafrechtlichen Teil schon diebisch freue?

Das Gutachten ist fertig; Auch wenn es weit unter den Möglichkeiten geblieben ist, kann man die Fakten nicht wegdiskutieren: Es gibt einen Haufen Übereinstimmungen, die kein Zufall sein können. Ich werde demnächst ein paar Auszüge einscannen und hier online stellen, dann kann sich jeder selbst ein Bild machen.
"Weit unter den Möglichkeiten" bedeutet, daß der Gutachter da noch mehr hätte rausholen können, z.B. finde ich es schade, daß er nicht erkennen konnte, mit welcher Programmiersprache Schiene und Strasse programmiert wurde (obwohl Delphi da mehrere Visitenkarten hinterlassen hat, u.a. Pfadangaben zu den Bibliotheken und den String "DELPHI32.EXE"), aber gut, lassen wir das. Was er gefunden hat, reicht. Schon die Hälfte davon würde reichen.
Mir fällt insofern ein Stein vom Herzen, weil ich seit Uebbings erfolgreicher Beweisvereitelung sehr paranoid geworden bin. Mein Alptraum war ein mit perfider Absicht ausgewählter, bestochener oder vertrottelter Gutachter, der strikt der unglücklichen Fragestellung des Gerichts folgt und "TT3D.EXE" byteweise mit "Schiene und Strasse.exe" vergleicht und zum Schluß kommt, daß es Null Übereinstimmungen gibt ("Schiene und Strasse.exe" ist nur das Menü mit dem Kopierschutz, das eigentliche Programm ist in der TTT_DX.DLL bzw. TTT_GL_DLL getarnt)
Aber gut, diese Befürchtung war gottlob unberechtigt.
Das war die gute Nachricht.
Die schlechte: Der Herr Vorsitzende Richter hat sein Wort gebrochen. Er hatte mir in der vorletzten Verhandlung, als ich schimpfte, daß mir das alles zu langsam geht, zugesichert, daß spätestens nach dem Gutachten alles viel zügiger als zu Beginn vonstatten gehen würde.
Tja, und nun habe ich die Ladung zum nächsten Gerichtstermin in der Hand:

Und sofort springt natürlich meine Paranoia wieder an, und ich frage mich: Wenn das Gutachten zu meinen Ungunsten ausgefallen wäre ... Wäre der nächste Gerichtstermin dann schon im Juni diesen Jahres gewesen?
Und wenn wir dann im Januar wieder beieinanderhocken werden ... Wird irgendjemand etwas sagen dürfen?

you are leaving one super news out. Peter got offer from "some" publisher, if he finish 3DTT in one year, they will publish the game! He also offering some money (% from the final deal) to the people who will help him to finish the game. I think he mostly need 3D artists. And not the last, he will need more or new betatesters!

there is a new judge (3rd one) who is female and much younger - A LOT more energetic then the previous two (who retired i believe)
she has to look through all the files - and will inform them what happens next on the 1. march....

this is excelent never knew there was so much of a mess behind the scenes with t&tt i have it and its a good game despite being incomplete i looked for a pach for ages
now i know why i didnt find 1 (i just d/loaded the 1 on this site to try it) its great to know we have a chance of a new complete vertion i hope it happens it has so much going for it
and i hope peter makes a lot of money from it he deserves it the game really is quality even as a bug riddled beta i have very high expectations for the finished game
i love the 3D models of real vehicle and that you can run roadtrains (even if an atkinson pulling 2 trailers looks wrong lol) i hope he keeps this in the game but just tidys it up so that it looks right could do with an a frame bogey so that the trailer sits behind the towing vehicle (unless its an artic truck of course) like the little reefer trailer does talking of which
i love puttin that little reefer trailer (the 1 that goes with the merc) behind a reefer artic it slows it down and doesnt add much load but it looks cool
am gonna have to go play this now this site has done it again

ps sorry if that middle bit is a little confusing i am not very good at explaining things in writing as u cant see me wave my hands about lol

he lost the court case and hes most likely going to appeal.
the court said that there was only 5% similarity between 3dtt and t&tt code - which isnt exactly true....

I just hope this was his first case, otherwise appeal would be less of use. The first appeal might offer a better insight in what exactly happend. I just hope that he doesnt give up since it is a wonderful game that deserves to be published by its rightful author...

damn, i hope he eventually wins, its looks a good game.
