the courts were supposed to decide how the case continues (on the 27)

however Peter hasnt yet commented on it, though he has been to the forums and posted, so who knows.

From observational experience I know that court cases can sometimes take a very long time and can be very, very stressful for those involved. Lets not add more stress to the situation by demanding updates, eh? :)

Well, google brings out a mess when I transcribe it in to its translating engine, but I get the impression the judge was telling someone off. I could be wrong, though. I'm seeing if I can get it translated by a friend of mine.

In brief:

I The court doesn't consider frustration of the evidence-gathering proces by the defendant [Mr. Übering] proven. The defendant hasn't been able to fulfill his obligation to hand-over information but the loss of storage media [HDD, CD's] is not considered as a result of the defendants actions [but a result of the bankruptcy procedure].

II The evidence-decission of 29/10/2003 is changed in such way that the evidence should arise by comparing the PC-game "Schiene und Strasse" from March 2003 (sales version) with the objectcode of the PC-game "3DTT" from 15/04/2000 [the comparison should yield if the codes resemble eachother, at wich part of the code that is the case and to what extent].
To be supplied by written expert report [Wolfgang Bannwitz is the assigned expert].

III The accusing party is ordered to provide a copy of the 2003 sales version of "Schiene un Strasse" for comparison.
To be carried out within 4 weeks after this decision.

IV Next date for a 'normal' court session for this lawsuit will be determined by the court.

yeah, basically what Hyronymus is correct (i would have to reread the german to find out more details)

it has takin him 3 years just to be able to get the source codes compared.

and Peters last comment on the forum was "Ja, ja ... Ist es nicht herrlich, wenn man schon fast gewonnen hat? "

Sorry John, I didn't intend to beat you. It wasn't easy German but when I reached the clue I knew what to make of the rest. I'm glad to hear that Peter is getting what he wanted. He certainly deserved it after all the hard times he went through (until now).
